Abstract:
In an effort to predict how courts will construe issued nanotechnology patents, Melissa D. Schwaller and Gaurav Goel analyze case law relating to the enablement requirement in two relatively established nanotechnology-related technologies: biotechnology and semiconductors. Specifically, Schwaller and Goel focus on the enablement requirement as applied to broad composition of matter claims, because of their prevalence across many technologies.
