Abstract:
The fates of nanotech companies could turn on how patent disputes are resolved. While some commentators have addressed the patentability of nanoscale inventions, little attention has been devoted to infringement issues in nanotechnology. Indeed, the commercialization of nanotechnology could turn on whether broad claims in microtechnology patents are infringed by nanoscale materials and devices. In this article, patent lawyers Robert Voigt and Edward Mickelson examine the implications of nanotechnology in but a single legal domain: patent infringement. After providing an overview of new nanotechnologies, the authors analyze novel legal issues associated with claim interpretation and infringement.
