Patentability and Enforcement Issues Related to Nanotechnology Inventions

Abstract:
The currently popular label, “nanotechnology,” is actually a broad term with poorly defined technical and legal boundaries. Despite recent and helpful efforts by the U.S. Patent & Trademark Office (“PTO”) to facilitate the classification of nanotechnology inventions, innovators in this multi-disciplinary field will continue to be faced with unique and challenging issues in patenting their ideas and in avoiding infringement of patents of other “nanotechnology” inventors. This article explores some of the current legal issues facing these inventors, with particular emphasis on “mere difference in size” as an issue in both obtaining and enforcing U.S. patents.
