Abstract:
Universities are generating groundbreaking inventions in nanotechnology. The growing portfolio of nanotech companies spinning out of universities suggests that lawyers, investors, and managers involved in nanotechnology would benefit from a detailed examination of the university technology transfer process. In this article, patent attorneys Behfar Bastani, Evelyn Mintarno, Jessica Akers, and Dennis Fernandez present an overview of university tech transfer, point out potential pitfalls for a nanotech company looking to bring the power of university research to fruition in its products, and illustrate different types of licenses and typical terms and conditions of licensing agreements.
