Top Ten Nanomaterials Patents Issued In 2007

large component of the nanotechnology law and business literature is devoted to the nanotechnology patent landscape. Large numbers of “building block” patents have been filed on nanomaterial compositions of matter, methods of making and processing nanomaterials, and applications of nanomaterials. In many cases, commercialization of nanotech-based products could turn on how patent offices around the world resolve pending cases. In the U.S., the sheer number of nanotech patents has resulted in time periods from patent filing to issuance that are substantially longer than for patents in other fields. As a result, some of the key nanomaterials patents have only recently issued.

In this issue, we highlight the “top ten” U.S. patents related to nanomaterials that issued in 2007. We did not engage in a rigorous legal analysis of these patents, and nothing in the article should be construed as legal advice. The purpose of the article to identify ten patents that are likely to be important in nanotechnology law and business.
