Patenting Nanotechnology Inventions in Europe

Abstract:
As nanotechnology-related patent applications have increased, government authorities have started to pay closer attention. With support from the European Commission, the European Patent Office set up a nanotechnology working group in 20003 to help prepare the Patent Office for the increase in nanotechnology-related applications. The working group set out an implementation strategy and defined nanotechnology. To date, the European Patent Office Appeal Board has not heard many nanotech-related cases. However, in the few it has heard, the Board set out important precedent that applicants must be aware of before filing their applications.
