Patent Drafting Considerations for Nanotechnology Inventions

Patent drafting strategies in complex technical areas can be rather “field-specific.” For example, despite the efforts of the USPTO to apply generic standards, claim language that is acceptable in one field might inadvertently lead to difficulties in establishing patentability in another field. Since nanotechnology is a relatively new field, so too are the claiming strategies that are likely to enhance favorable prosecution. This article presents some of the important points to consider when writing a nanotechnology patent, with particular emphasis on claim drafting.
